The League is FOR Senate Bill 474, introduced by Senator Lois Kolkhorst (R-Brenham). The companion bill in the House is HB 3339 introduced by Rep. Cindy Burkett (R-Garland). This terrific bill will begin to level the playing field on eminent domain proceedings between landowners and condemning authorities by awarding attorney's fees for those landowners who industry gives low ball offers to, hoping the landowner will not have the resources to go to court.

  1. Concur with the bill and expect Mr. Bell to vote for it. Property owners should not have to incur any expense in contesting low ball offers for their property. Even if the property owner loses in the proceedings, the condemning authorities should be liable for any or all legal or other fees required for the proceedings.
